§ 44-60. Who to command
The naval forces shall not be considered as attached to any division or brigade of the land forces of the Commonwealth, but shall be under the direct command of the Adjutant General and ultimately the Governor as commander in chief. When, however, the naval militia, or any part thereof, shall be in the field or afloat upon actual service, the senior officer present shall be in command, and whenever operating or acting in conjunction with the land forces of the militia of the Commonwealth, the senior officer present, according to relative rank of either force, shall command the whole, unless otherwise specially ordered or directed by the Governor as commander in chief or other competent military or naval authority.
