DECISION ON APPEAL
This is a decision on appeal under 35 U.S.C. § 134 from the examiner's final rejection of the
following design claim:
The ornamental design for a baking pan as shown and described.

The Rejection
The claim stands rejected under 35 U.S.C. § 103 as being unpatentable over EKCO in view of
Finley and Young.
Opinion
The claimed subject matter is directed to the ornamental design for a shallow baking pan having
a rectangular shape and including twin grip handles, each having a hole therein, with sloping sides from the
top rim of the pan to the bottom of the pan. The rim of the pan is a wide flat trim
