Appeal No. 1998-3367 Application No. 08/545,717 Appellants’ invention pertains to a garment having an absorbent section and a waist belt attached directly thereto. Of particular interest to appellants is the provision of a garment of the type noted that includes a waist belt having a stiffness within a specific range. A further understanding to the invention can be derived from a reading of exemplary claim 1, which appears in an appendix to appellants’ main brief. The single reference of record relied upon by the examiner in support of rejections under 35 U.S.C. § 102(b) and 35 U.S.C. § 103 is: Gipson et al. (Gipson) 4,964,860 Oct. 23, 1990 Claims 1, 2 and 4-13 stand rejected under 35 U.S.C. § 112, first paragraph, as being based on a specification that “does not enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make the invention” (answer, page 4).
