Appeal No. 2005-0524 Application No. 10/028,124 no such anticipation was shifted to appellants to rebut the examiner’s findings. Appellants’ response is to contend that Noyama “neither explicitly nor impliedly teaches ‘establishing a set of image samples from a set of image sample values and geometrical parameters [V]’” (brief-page 4). The examiner has identified the composite image 50 of Noyama as comprising the set of image samples, which are established from a set of image sample values (CG image 20) and geometrical parameters (from transformation data memory 21). Thus, the mere allegation, by appellants, that Noyama does not teach these claimed features, without more, is not convincing of non- anticipation. Appellants then argue that the composite image and original CG image of Noyama “is not substantially similar to the presently recited ‘image samples’ and ‘image sample values’” (brief-pages 4-5) because the present application discloses that an image sample is “a weighted combination of several values from the set of image values” and that there are “different types of image sample values: luminance values, chrominance values, opacity values and Boolean values” (brief-page 5). Therefore, appellants conclude that “nowhere in Noyama. . .was it disclosed that the -4-Page: Previous 1 2 3 4 5 6 7 8 NextLast modified: November 3, 2007
