Appeal No. 2005-0896 Application 09/947,125 The appellants argue that neither Angulas nor Melton suggests the specific type of connection of the chip to the substrate required by claim 9 (brief, page 4). The examiner finds that Angulas’ high density patterns (col. 4, lines 67-68) are similar in structure and orientation to a BGA arrangement (answer, page 7). Because this finding is reasonable and has not been challenged by the appellants, we accept it as fact. See In re Kunzmann, 326 F.2d 424, 425 n.3, 140 USPQ 235, 236 n.3 (CCPA 1964). Accordingly, we affirm the rejection of claim 9. DECISION The rejection of claims 6-14 under 35 U.S.C. § 103 over Angulas in view of Melton is affirmed. 7Page: Previous 1 2 3 4 5 6 7 8 9 NextLast modified: November 3, 2007
