Appeal No. 2005-0912 Application No. 10/233,459 The subject matter on appeal relates to an electroluminescent device. According to the appellants, “[e]lectroluminescent devices, in particular light emitting diodes (LEDs), are ubiquitous to modern display technology.” (Specification at 1.) Further details of this appealed subject matter are recited in representative claim 1 reproduced below: 1. An electroluminescent device comprising: hole processing means capable of injecting and transporting holes; a light emitting layer in contact with said hole processing means, comprising quantum dots; each of said quantum dots being provided with at least one capping molecule with functional unit on the quantum dot surface which causes excited state injection into the quantum dot; and electron processing means in contact with said light emitting layer for injecting and transporting electrons into said light emitting layer. The examiner relies on the following prior art references as evidence of unpatentability: Jenekhe et al. 6,605,904 B2 Aug. 12, 2003 (Jenekhe) (filed Jan. 31, 2001) Bawendi et al. 99/26299 May 27, 1999 (Bawendi)(published PCT application) (2003)(effective Feb. 5, 2001) on Jun. 30, 2004, proposing a change to claim 1.
