Appeal No. 2005-1226 Page 3 Application No. 10/151,179 city/country to be used with a clock/watch, wherein the second symbol is positioned a number of hours ahead relative to the first symbol on a sticker sheet2 according to the number of hours a second time of the second city/country is behind a first time of the first city/country. Kim discloses an hour dial 32 divided into twelve equal sectors 44, each sector resembling an arrowhead, with the city whose time is being indicated by a particular sector being identified by permanently etching the name of the city on the sector or by placing a sticker 47 over the surface of the sector. The hour dial 32 is mounted on a clock for movement with the hour hand 30. As the hour hand 30 indicating the local time rotates, the hour dial 32 likewise rotates so as to indicate at all times the current time in each of the cities identified on the sectors 44. As illustrated in Figure 4 of Kim and explained in the paragraph bridging columns 3 and 4, the sticker or symbol for a second city, such as Los Angeles, in which the time is two hours behind the time in a first city, such as Mexico City, is positioned on the hour dial two hours counterclockwise relative to the sticker or symbol for Mexico City. This, of course, is the reverse of the arrangement recited in appellants’ claims. 2 We note that claims 10 and 32 do not positively recite a sticker sheet. Accordingly, the reference to the second and first symbols being positioned “on the sticker sheet” lacks antecedent basis in these claims. Upon return of this application to the primary examiner, the examiner should consider whether such lack of antecedent basis renders the claims indefinite. At the very least, these claims would appear to be deserving of correction to cure this informality, as well as other informalities. For example, claim 32 does not recite “around the center” of what the angular position of each of the symbols is determined by time difference between each city.
