Appeal No. 2006-0945 Application No. 10/245,888 rationale both for applying the learning capacity of Narita I to Narita II and for applying the bifurcated processing based on the ON/OFF status of an air conditioner in Narita II to Narita I, and that such an application would have therefore been both obvious to, and within the capacity of, one of ordinary skill in the art, we sustain the rejection. Accordingly, the decision to reject claim 1 as being unpatentable over 35 U.S.C. § 103 over Narita is affirmed. Claim 2 Appellants argue that Narita fails to show: coasting lockup capacity [that] is a required minimum lockup capacity obtained by adding an estimated value for bringing the slip rotation to zero, to a lockup capacity with which the slip rotation becomes a predetermined slight-slip rotation [See brief at p. 7]. As the examiner has indicated, Narita shows: This processing is as shown in FIG. 4, and the driving duty D is set to 100% for the time being in coincidence with the fact that the driving state is in the lock-up region L/U at the step 32, until the time during which the coasting drive continues at least for a predetermined time at the step 31, namely, until the coasting drive becomes stable. When the coasting drive continues over the predetermined time and the coasting drive is stabilized, the application capacity of the lock-up clutch for the coasting drive is retrieved on the basis of maps provided for each gear position, from the vehicle speed V and the transmission hydraulic oil temperature C, and the driving duty Dc % for achieving this capacity is calculated to set the result to the lock-up solenoid driving duty D at the step 33 [emphasis added; See Narita col. 9, l. 17-30]. The operation at the step 28 is as shown in FIG. 6 instead of FIG. 4, and the step 44 at which the learning control flag FLAG is reset to 0 follows the step 32 to prevent the unnecessary erroneous learning while the steps 45 to 55 are added after the step 33.
