In conclusion, based on the foregoing, the Examiner's decision
rejecting the appealed claims is reversed. Also, the application is remanded
to the Examiner for consideration of a rejection of the appealed claims under
35 U.S.C. § 103 for the reasons set forth above.
It is important that the Board of Patent Appeals and Interferences be
informed promptly of any action affecting the status of the appeal (i.e.,
abandonment, issue, reopening prosecution).
