The Examiner entered the following rejections.
I. Claims 9, 15, 17, and 35-37 stand rejected under 35 U.S.C. § 102(b) over
Meltser.1
II. Claims 9 and 15-19 stand rejected under 35 U.S.C. 102(e) over
Clingerman.
III. Claims 9, 10, 15-17, 26, and 29-34 stand rejected under 35 U.S.C. §
102(b) over Wilkinson (WO 00/02282).2
IV. Claims 11 and 12 stand rejected under 35 U.S.C. § 103(a) over
Clingerman in view of Zhang.
V. Claim 28 stands rejected under 35 U.S.C. § 103(a) over Clingerman in
view of Grot.
VI. Claim 38 stands rejected under 35 U.S.C. § 103(a) over Meltser.
The Rejections over Metzler.
Claims 9, 15, 17, and 35-37 stand rejected under 35 U.S.C. § 102(b)
over Meltser.3
1 The Examiner has withdrawn the rejection of claims 18 and 19 over
Meltser (Answer 8).
2 The Examiner has indicated that the Wilkinson reference cited in the
rejection is WO 00/02282 and not U.S. 6,673,480 cited in Appellants’
principal Brief.
3 3 Appellants have presented arguments for all the claims together except
for claim 35. Consequently, except for claim 35, all the claims will stand or
fall with the arguments presented for independent claim 9.
