Appeal 2007-0664 Application 09/794,420 claim language itself or the disclosure. Even as disclosed and claimed there is no explanation of what lowering one level is to mean in the context of degrading an image, as also addressed by the Examiner at page 6 of the Answer. The artisan may well consider, then, that turning off every third pixel would degrade the image one level to the extent claimed. In view of the foregoing, the decision of the Examiner rejecting all claims on appeal under 35 U.S.C. § 103 is affirmed. No time period for taking any subsequent action in connection with this appeal may be extended under 37 CFR §1.136(a). See 37 CFR § 1.136(a)(1)(iv).
