Appeal 2007-2358
Reexamination Control No. 90/006,888
12. The second requirement is that the optical transmission element must
be protected "against tran[s]versal forces as well as dynamic stresses."
(Oestreich at 2:20–21.)
13. According to Oestreich, the second requirement "calls for a material
having a high modulus of elasticity and great toughness." (Oestreich
at 2:21–23.)
14. Oestreich teaches that suitable materials for the outer layer include
polyamide, polyterephthalate, polypropylene, or polyethylene. (Oestreich
at 2:59–62.)
15. Oestreich Figure 1 illustrates the protective casing.
{Oestreich Figure 1 is reproduced shown below:}
{Oestreich Figure 1 is said to depict a protective casing.}
16. Oestreich Figure 1 shows an optical transmission element 1 and the
casing 2, which has an outer layer 22 (polyethylene) and an inner layer 21
(TeflonŽ). Note the spacing between optical transmission element 1 and
casing 2, which is provided so the element 1 can move within the casing 2.
(Oestreich at 3:31 to 4:5; extraneous labels have been removed for clarity.)
