Claim 1 is representative of the subject matter on appeal and a copy of claim 1, as it appears in the appendix to the appellants' brief, is attached to this decision. The prior art references of record relied upon by the examiner as evidence of obviousness under 35 U.S.C. § 103 are: Morikawa et al. 2 59-70811 April 4, 1984 (Morikawa) (Japan) Vaccari, "Laser shocking extends fatigue life," American Machinist, pages 62-62, July 1992 In addition, this panel of the Board will rely upon admitted prior art (see page 5, infra). Claims 1 through 5 stand rejected under 35 U.S.C. § 103 as being unpatentable over Morikawa in view of Vaccari. 2In determining the teachings of Morikawa, we will rely on the translation provided by the PTO.
