Appeal No. 1996-0270 Application 08/118,128 recited in claim 19 would have been fairly suggested to one of ordinary skill in the art by Sun for the reasons given above regarding claim 1. Conclusion For the above reasons, we conclude, based on the preponderance of the evidence, that the methods recited in appellant’s claims 1, 2, 19 and 21 would have been obvious to one of ordinary skill in the art within the meaning of 35 U.S.C. § 103. DECISION The rejection of claims 1-5, 8-10 and 19-22 under 35 U.S.C. § 103 over Sun in view of Pignatello is affirmed. No time period for taking any subsequent action in connection with this appeal may be extended under 37 CFR § 1.136(a). AFFIRMED ) CHUNG K.
