The rejection of claims 1 - 4, 15, and 16 under 35 U.S.C. § 103 as unpatentable over the combination of Wagner, Heilmann, and Ishii is reversed. This opinion includes a statement under 37 CFR § 1.196(c) authorizing the cancellation of the phrase "substantially free of other enantiomers" which would overcome the ground of rejection under 35 U.S.C. § 112, first and second paragraph.
