The rejection of claims 21-24 under 35 U.S.C. § 112, ¶ 2, is reversed.
The rejection of claims 19 and 20 under 35 U.S.C. § 102(b) over Weber is
affirmed. The rejection of claims 21-24 under 35 U.S.C. § 102(b) over
Weber is reversed. The rejection of claims 21-24 under 35 U.S.C. § 103(a)
over RD ‘439 in view of Weber is reversed. Accordingly, the decision of
the Examiner is affirmed-in-part. The application is also remanded to the
Examiner for action consistent with our remarks above.
No time period for taking any subsequent action in connection with
this appeal may be extended under 37 C.F.R. § 1.136(a)(1)(iv)(2004).
