Appeal Number: 2006-1694 Application Number: 10/131,607 OPINION We affirm the rejections under 35 U.S.C. § 103, reverse the rejection under 35 U.S.C. § 112, and remand the application to the examiner. Rejection over Mücke Mücke straightens metal strip to eliminate departures from flatness that need to be eliminated for subsequent treatment of the strip and for use of the finished strip (col. 1, lines 5-12 and 23-35). “Such departures from flatness can take the form of curvature of the strip in the longitudinal direction, transverse curvature and transverse, central and edge waves or the formation of a camber as a result of differences in the width of the strip” (col. 1, lines 14-18). The strip is straightened by being plastically deformed as it passes through two straightening gaps, each gap being between a straightening roll (18 and 19) (one straightening roll being on each side of the strip) and a pair of backing rolls (14, 15 and 16, 17) (each pair of backing rolls being on the side of the strip opposite the respective straightening roll) (col. 4, lines 1-24; fig. 3). “On the exit side three sensors 29, 30 are arranged above the strip 5 by means of which any curvature of the strip remaining after the straightening can be determined and compared with an intended value.
