CONCLUSION
In summary we will not sustain the Examiner’s rejection of claims 1 through
3 under 35 U.S.C. § 102(e) as anticipated by Konopka. However we sustain the
Examiner’s rejection of claims 1 through 3, 9, and 10 under 35 U.S.C. § 102(e) as
anticipated by Lieder, and the Examiner’s rejections of claims 4 through 8, and 11
under 35 U.S.C. § 103(a). The decision of the Examiner is affirmed.
No time period for taking any subsequent action in connection with this
appeal may be extended under 37 C.F.R. § 1.136(a)(1)(iv) (2006).
