Appeal 2007-2254 Application 10/383,115 On this record, Appellant’s claim 1 is directed to the discovery of a new benefit of the old process taught by Amin. In my opinion, this newly discovered benefit of Amin’s process does not render Appellant’s process patentable. Accordingly, I agree with the majority’s decision to affirm the rejection of claim 1 under 35 U.S.C. § 103.
