We reverse the examiner’s rejection of method Claim 11 under 35 U.S.C. § 103 in view of the combined teachings of Kremer, Innis I, Innis II, and Mullis. We affirm the examiner’s rejection of Claims 42 and 29-33 under 35 U.S.C. § 103 in view of the combined teachings of Kremer, Innis I, and Innis II. This rejection constitutes a NEW GROUND OF REJECTION UNDER 37 CFR § 1.196(b). We remand this application to the examiner for consideration anew of the patentability of the claimed subject matter under 35 U.S.C. § 112, second paragraph, 35 U.S.C. § 112, first paragraph, and 35 U.S.C. § 103.
