Cir. 2002). With these principles in mind, we commence review of the pertinent evidence and arguments of Appellant and Examiner. Appellant argues that the Examiner has failed to provide any evidence to support why one of ordinary skill in the art would modify Akimoto with the teachings of Cauge to use the gate type structure in Akimoto’s solid-state imaging device.
