Appeal No. 2005-2393 Application No. 10/228,392 APPEALED SUBJECT MATTER The subject matter on appeal relates to a golf club shaft set with shafts defining upper (butt) ends and metal tip ends wherein the lengths of the metal tip ends are inversely proportional to the overall lengths of the shafts. Claims 1, 10, 19 and 20 are representative of the appealed subject matter2 and read as 2 The appellants state at page 7 of the Brief that: Claims 4, 6 and 7 depend from claim 1 and stand or fall with claim 1. Claims 13, 15 and 16 depend from claim 10 and stand or fall with claim 10. Claim 20 depends from claim 19 and stands or falls with claim 19. Consistent with this statement, the appellants do not provide any substantive arguments for the separate patentability of claims 4, 6, 7, 13, 15, 16 and 20.
