Appeal No. 2005-2512 Reexamination Control No. 90/006,431 This is an appeal under 35 U.S.C. §§ 134 and 305 from the examiner's final rejection of claims 1-18, which are all of the claims subject to reexamination, under 35 U.S.C. §§ 112 (first paragraph), 102, and 103. The examiner has withdrawn the § 112 rejection, Ans. 3,3 leaving only the art rejections for our consideration. We affirm in part and reverse in part. A. The real party in interest The real party in interest is the current patent owner, Synopsys, Inc., of Mt. View, California (“Synopsys”). In 1997, Synopsys acquired the original assignee, i.e., EPIC Design Technology, Inc. of Santa Clara, California (hereinafter “Epic”), and the ‘876 application, which matured into the ‘952 patent.
