Application 09/460,222
which as filed included reissue claims broader in at least one respect than the claims of
the original patent, issued on December 14, 1999, as Reissue Patent RE36,445 (“the
reissue patent”). The reissue patent contains all of the original patent claims (i.e.,
claims 1-24) plus new claims 25-82.1 The reissue patent and the application on appeal
are assigned to Matsushita Electric Industrial Co., Ltd., of Osaka, Japan. Opening Brief
at 1.
B. The rejection
Claims 26, 28-32, and 34-38 stand rejected under 35 U.S.C. § 251 on the ground
of reissue recapture.
