Appeal 2007-1914 Application 10/378,641 We conclude that the Appellant has failed to show that the Examiner erred in rejecting: claims 81, 87, and 91 as anticipated by Borst; claims 81-83 and 87-89 as anticipated by Nickerson; claims 43, 48-51, 54-58, 65, and 66 as unpatentable over Nickerson and Schwartz; and claim 40 as unpatentable over Rivard, Schwartz, and Nickerson. DECISION The decision of the Examiner to reject claims 40, 43, 48-51, 54-58, 65, 66, 81-83, 87-89, and 91 is affirmed. The decision of the Examiner to reject claims 1, 2, 15-17, 23-28, 30, 31, 33-39, 41, 44-47, 52, 61, 62, 70-73, 75-77, 79, 84-86, 90, and 92 is reversed. No time period for taking any subsequent action in connection with this appeal may be extended under 37 C.F.R. § 1.136(a). See 37 C.F.R. § 1.136(a)(1)(iv) (2006).
