Q Do you know whether that's the amount that you
were charged on the bill?

The question is do you know whether the amount
that you agreed upon with Mr. Tupitza is the amount
that's reflected on the bill.
A I would have to review my documents to see what
I had agreed. I have it written down some place and I
would have to look it over. I did look it over after I
looked at this bill and I realized that (sic) it was,
but I don't remember exactly what it was. I think it
was approximately $100 but I'm not sure what the hourly
fee is. [Emphasis added.]
Q Did you have an understanding with Mr. Scott as
to the hourly fee that would be paid him for work done
on the theft loss issue in this case?
A Well, I had employed Mr. Tupitza and he
employed Mr. Scott.

Q Do you know how much Mr. Scott's part of this
bill is for the litigation of the theft loss issue?
A I would have to figure it out. I'm not sure.
I just received one bill.
Q Do you know if there is an agreement between
Mr. Scott and Mr. Tupitza -- I'm sorry. Strike that.
Did you agree with Mr. Tupitza as to how much Mr.
Scott would be paid, or did Mr. Tupitza set that fee?
A. I spoke with Mr. Tupitza originally and he
told me what he was going to charge and then he
employed Mr. Scott and they dealt with it. I didn't
talk to Mr. Scott about this.
As a witness, Panepinto's forte seems to have been
tergiversation, and we do not credit her testimony.
