               Appeal 2007-1942
               Application 10/368,975

               2. Figure 3, below, is said to illustrate the invention.

               3. The fabric 12 is said to possess a five layered structure, “including two
nylon cloth layers, or cloth-like, outer layer[s] 14, 15, two cushioning
foam, or foam-like, intermediate layers 16, 17, and a central non-
stretchable strand (such as KevlarŪ) inner layer 18.” (Specification 3-4).
               4. As shown in Figure 3, the claims each require that the polyethylene
layers 16, 17 be symmetrically disposed about the central aramid strand
                   (18).
               5. In other words, one of the polyethylene layers is on the front of the
central aramid strand and the other is on the back of the central aramid
                   strand.
               6. The phrase “symmetrically disposed” is not defined in the Specification.
               7. Sacks discloses a protective shield such as a bullet-proof vest.
               8. Generally, the fabric of the shield is described as comprising a
penetration resistant layer of aramid fibers (such as KevlarŪ) and a
backing layer of one or more thin, flexible sheets of semi-stiff impervious
plastics material (such as polycarbonate). (Sacks 1:40-46 and 3:45-52).
               9. Sacks discloses that “said backing layer acts to limit transmission of
impact shock to the person’s body” and to “absorb and spread shock

                                                     4
