as the efforts of NTS may have been, such efforts involved nothing
more than the skilled practice of those in the information
technology industry.
G. Trust Payment
Dr. McDermott identified two complex issues in developing the
Trust Payment system which related to performance and reliability.
These involved "optimizing" the programs to make them run faster
and more efficiently and attempting to avoid "locking" of the
system when too many users were accessing data. He found that the
changes to this system were "more difficult than usual" because
small changes could disrupt the logical structure of a larger
system.
Dr. Davis stated that the task of developing the Trust Payment
system, and the technology used, were familiar and well established
in the industry. He found nothing uncommon about interfacing a new
system to other older systems. Dr. Davis conceded that uncertainty
over NTS' ability to develop a system to meet Norwest's
requirements may have existed, but he denied that any new
principles of computer science were discovered through the routine
use of standard tools that had been around for many years.
Finally, he found that the problems and solutions encountered by
Norwest in the development of this system were routine.
Mr. Teixeira, as in the case of the Trust TU system, made
reference to the fact that Norwest was a mid-tier trust service
provider, and that other trust service providers processed as many
