- 6 - per day and also agreed to provide the electricity necessary to operate three of petitioner’s pumping stations. The wastewater must meet the California Department of Health Services standards for tertiary treatment, and Company will have the right to access petitioner’s facilities and records to test the water or verify its quality. Company will pay no fees, directly or indirectly, to petitioner for use of the wastewater. Company will use the wastewater to generate electricity for sale to customers. To do so, Company has to take the wastewater and inject it into the ground where the wastewater will become heated and produce steam. Petitioner will not receive any revenues from or other interest in Company’s electricity operation. Petitioner will provide all labor, materials, and capital for the construction, operation, and maintenance of the pipeline and related facilities from the existing sewage system to a “point of delivery connection”.6 Company will provide all labor, materials, and capital for the construction, operation, and maintenance of additional pipeline and related facilities from the point of delivery, as well as the electric supply facilities for three of the four pumping stations along the 6Petitioner is obligated to supply the wastewater at a “point-of-delivery connection”.
